Unauthorized Use of Photo

I've seen plenty of threads on the site about photographers' photos being ripped off and used for advertising purposes. How about if your police booking photo was ripped off and used to advertise a background check website? Somebody is going to lose some money on this one, that is if they have any.

Hmm.. this one will be interesting. Mugshots are generally coincided in the public domain thus usable by anyone. If the site is using it commercially and attributing it to a crime she was not arrested for, some other law might come into play but I think they have the right to use the photo.


Not sure why, but call me JJ.
I used to hate math but then I realised decimals have a point.

Not sure what the Florida statues on this are, but mugshots in many states are part of the public record.
Some states are taking steps to protect them until the party in the photograph is convicted, but it's not happening everywhere. This could be an interesting one to watch.

I guess she shouldn't have been drinking and driving then.

I should sue her because people who drink and drive cause me mental anguish and disturb my peace of mind.

If I see the disposition of this case in the future, I'll follow up. Mug shots are public record, and I guess we'll find out if they can be used for advertising purposes.

Mugshots are public domain in Florida. If anything the state should be going after the advertisers as they own the photo. I am sure that she gave up all her rights to anything when she was booked.

Or refused a breathalyzer test. You'll still get arrested and booked...and ultimately have a mugshot taken.

She was still drinking and driving, even if she managed to weasel out of the law side in some manner.
