i shot a local hockey team for 3 of its 4 years existence...

im not a super pro like some of our other esteemed Puck guys but i like most of my work...

well after the team folded at the end of last year (really didnt fold, just moved) the left over sweaters and swag must have been sold off at a discount to a sports memorabilia dealer. i was looking for some other hockey gear on the Ebay and i found a seller with about 7 of the teams game worn sweaters with "photo matched" showing the sweater being worn in a game by the named player...

so i look at the ad and low and behold, MY PHOTO of the player (i was the game day shooter) is being used in the ad. some of the photos are cropped to show just the player which removed my branding...

i messaged the seller and she replied that she "thanked me for the great photo" she used in the ad but i never saw anything about my work. she also removed the offending photos...

wow. ive never had that happen before. kind of makes me all warm inside!

Yeah, I'd be a little miffed if my photos were used without permission. Not only that, they cut out your branding and the only way people would even know they were your photos.

oh, dont get me wrong...

i was quite pissed. i addressed all 8 of her ads telling her to remove my photos from her ads and explained that if they were cropped to "remove" my id that she was willfully stealing intellectual property and she would be subject to criminal and civil actions...

i just never had anyone "like my work" enough to go to this much bother...

Criminal? Too much TV involved in that statement.

I'm always amazed when people who have copyright violations just issue take down demands instead of getting paid.

I picked up a copy of our karate grand master's new book a few weeks ago. His last book is still highly sought after and I felt lucky to get a copy of the new one. I was thrilled when I looked inside and saw a picture of my son with his class in the book. People for years to come will see this book and I was a proud father to see my son's picture in the book, until...
I realized it was not only a picture of my son, it was MY picture! I did not post this one online and only gave out a few copies of the print. Looking in the book, it looks like someone either poorly scanned my picture or snapped a picture of my picture to provide to the publisher. Yep, I'm a somebody too :(

well since im NOT a lawyer, just how much do you figure it would cost to bring a lawsuit (civil) against the seller for half-dozen images about half the size of a computer screen? and what do you supposed i would gain?

I'm guessing some percentage of your award, except that a DMCA violation allows for awards of damages + attorney's fees. So, I would say 2,500-25,000 per image with your information cropped out.
