Angles and Perspective...

Behind the scene candid of an editorial photoshoot we did several weeks ago in downtown Los Angeles... This beautiful and sexy lacy gown was designed by Stello and agency model Ximpy wore it very well... Profoto B1 was used for fill with a mixture of natural light... I forgot to pack my Westcott 36" Deep Octa (bad Butchie)... But we were still able to use the strobe without it... 1DX + 16-35L II + Lee 105mm CPL and 0.9 SE GND Filter (stacked)... ISO 200, f/2.8 @ 1/1250sec...

Hey everyone! Bit of an ethics question.

(Id ask in the Talk forums but they dont seem active)

I got paid by a designer so shoot her collection. I gave her unwatermarked photos for her use and waterwarked photos to give to the models who were paid. Now the agency that one of the models work for is contecting the designer asking for unwatermarked photos for the model's portfolio. Thoughts?

You were paid to shoot only for the designer. In my contract I state that the photos are only for the client who has hired me, and that any additional use requires a new agreement. So if the modelling agency wants to use your photos, they must work out a deal with you. Those photos are still technically yours, even though the designer hired you. She cannot provide them to anyone else for use outside what you have agreed with her to do. I would not provide those photos to the modelling agency unless it doesn't matter to you that they will use them without compensating or crediting you.

I always make sure the client is clear with me how he/she is going to utilize the photos. This gives me an idea of what to charge. For example, if a band hires me for publicity photos, they can only use those photos for publicity and not in CD art. That's a separate licensing agreement. So in your situation, the photos' original intent (assumedly promo for the designer) is extending beyond the agreement.

The kick is that I felt I was being a pretty nice guy to give them watermarked images and they want the watermark moved or removed. The images are on white seamless so I watermarked over the model in the middle to the right obscuring them a bit. Removing a watermark on a white background sounds too easy. The agency also as alot of differnt styles of images on there website all watermarked with there logo which makes me think they are going to watermark it with there own one.

agency should contact models and get those pics . Designer doesn't have any responsibility.
