Nikon (read: Sony) DX sensors have always been slightly larger. Hence the 1.5x crop instead of 1.6x

I think it is, albeit slightly. d300 specs show 23.6x15.8, while the 40D specs show 22.2x14.8.
Of course, the 30D specs show 22.5x15....40D actually smaller?? hmmmmm........
