I recently purchased a used 40D that supposedly had all the original software. Not knowing what that was I assumed I had it all. Today while reading a book on the 40D by David Busch I decided to load it.

I only have Software Instruction disc and a Products and Solution disc which is only ads.

My question: Should I try to find a copy of the software or just get another party one like Photoshop or something?

All replies appreciated, I am several steps below a novice.

Read this thread and it will show you how and where to get the latest Canon software. The Canon software is an excellent place to begin, but read the threads in this section of POTN for a while to determine what other software might suit your needs as a beginner.
