does anyone have a solid responsability waiver?

A person has contacted me about a portrait, and they want to involve their motocross bikes. Since this gets into a dangerous area, and if something were to happen, I do not want to be held responsible. I do have liability insurance but I do not want to use it if i can avoid it, no need to get the rates to get raised.

I would make up a waiver myself in plain english, but that probably wouldnt hold up in court. I know the first answer is to contact a laywer, but I do not want to pay $400 for a piece of paper from a book that they just changed the name on, for a $125 portrait session.

I am a member of PPA, I wonder if they have something like this free on their site.

Before I say anything, bear in mind I have no legal knowledge whatsoever and as such could be completely wrong but...

Why would any legal responsibility fall on you if they were to get injured? They contacted you about the shoot and they want to use the bike. You're just taking the photos.

because the country is full of lawyers and its always the other persons fault. and if you ask them to do something and they get hurt, your responsible. I was the one that mentioned getting action shots, probably shouldn't have, just hinted so they would ask for it. they have no problem signing the release, because "they always get hurt". :)

I found a couple online that look pretty solid. I should have kept the link to the two of them so I could paste here. Lets see fi its in my history.

A. No, PPA doesn't have anything like that free on their site. I doubt something both nationally generic and legally effective could be drafted.

B. That's something you'd really have to pay a lawyer to have drafted for you. It's pretty hard to absolve yourself of all responsibility if you do any directing of the action at all. Even having a signed statement doesn't prevent a court from saying, "That's crap" and tossing it out. Something like a "Let's do that again" could make you legally responsible for an accident that happens that last time.
