The Citadel news/talk outlet is one of 32 defendants being sued by Righthaven LLC for using a copyrighted photo on its website. The photo in question was published by the Denver Post in November of an “enhanced pat down” at the Denver airport and was used in WPRO’s online caption contest. Righthaven – which acquires the copyrights from Denver Post parent MediaNews Group, Inc – is suing WPRO and others for $150,000 for the infraction. The Las Vegas Review-Journal reports Righthaven has been criticized for suing first instead of asking the photos to be taken down but Righthaven CEO Steve Gibson says that tactic doesn’t stop anyone. “I think over the past 15 years, it has been made fairly clear that you're not going to get a reduction in the level of infringements and the respect of the infringement community just by asking them to take it down.” The paper reports Righthaven has filed 230 such suits in Nevada alone but that most are settled for an average of about $5,000.
