
You'd have as much chance as getting your money back from a Nigerian email scam I reckon.
If he has an admission of guilt it's not very hard to get a judgement.

All went the same way, got item shipped to me even a tracking number...then an email just about like the one you got....two days later my lens showed up in perfect shape. I have 335 heatware feedback just for trading, buying, selling computer gear at Anandtech, besides the 523 feedback from Ebay. In all these years Ive never taken advantage of new sellers, asking them to ship first, but my outlook has changed somewhat now and I may ask for a ship first from now on with brand new sellers, regardless if they have history at Ebay or not. Maybe a verifiable track history at another site where I can ask for references from members I know would be an exception, but brand new peeps will likely not get anymore passes from me. A few bad apples and a now easy path to rip folks off thru Paypal has forced my changed way of thinking now. Too bad, I have always had good results in the past just being smart and relatively cautious...now you have to put up the shields more than ever.

I just sold off a bunch of high end and was settling for low end stuff as my priorities have changed. So my purchase was only 350.00. But it just so happened that a lens that I returned to a seller on Ebay and got a full refund on that same week turned out to reverse itself because the seller had insufficient funds in his backup finance source to cover the funds. Then he was locked out of his account for sending funds. So suddenly I have this wanker gank me, AND the refund pulled all at the same time... when I have never been skunked ever before. It happens, no matter how careful you think you are, you will one day let the guard down one click of the mouse too long.
