Apologies for the rather blunt title, it's from the local paper to which I've linked.

Reading it I know there are some unsavoury aspects to what he's done and whilst I wouldn't go out taking candids of children I do like to so "street" stuff involving adults. Reading that makes it sound as though he's committing an offence, surely thats not right?

Some quotes..

Recorder Kevin de Haan QC told him: "It was a gross invasion of a young person's privacy."

Prosecutor Lisa Hennessy said in August last year a member of the public reported him apparently taking photographs of children outside the Aviator pub at Gloucestershire Airport at Staverton during an airshow.

"He had a long lens zoom camera which he was repeatedly pointing at a group of children playing in a fenced off area," she said.

The same member of the public had seen Fennell, who worked for Severn Valley Waterworks, twice doing the same sort of thing before.

Any thoughts?

This really has more to do with child molesters than it does with photography. I'm sure that many of them have geared themselves with the same sort of gear as the dude in the article.

Personally, I don't see the need for this thread as someone is bound to defend his rights to shoot in public but once you are registered as an offender you have no rights,imo.

Who doesn't have a long lens at an airshow.


My life is like one big RAW file....way too much post processing needed.

It just struck me as I was reading it that I didn't believe that there was a law against taking photos of people in public without their permission, regardless of age yet legal people are making it sound like there is.

I know there seems that this is a second offence but he's obviously been done for taking candid shots previously.

You need to reread it , he couldn't take pictures without consent , because of his first offence .

I appreciate that, thats the point I was making, it seems that his first offence was the same thing.

Moreso my main point is that the court seems to be saying that it's an offence to take photos of people without their consent, which I believe to be untrue.

Your not reading the whole article

"Fennell had received the SOPO in 2007 when he admitted that he kept a secret videotape of children being abused under his bed"

So his original offence was for having a video of child abuse.

In the UK there is no law against taking photos of anyone in a public place no mater what their age.

He has not been sentenced for taking photo but for being in breach of a sex offender's order

Fair enough, I read it as he'd done both.

I thought there may be a precedent.
