My mistake was in cs5 I had the crop tool set to rule of thirds and raw editor was set to 2 to 3

2:3 is correct.

Ah, well, that's why we asked you to show us a screen shot of your Photoshop crop settings, but I guess it can be helpful when you find things out yourself!

User error - Tim's original point. I'm sorry you got upset, but don't worry too much - nobody's perfect. We've all made mistakes, from the silly to the sublime. At least I have.

First question: Why are you cropping in both ACR and CS5?

Secondly, Having the crop window display the rule of thirds guides doesn't have any effect on the proportion / aspect ratio of your image.
They are just guide lines used for composition and have no effect on maintaining the aspect ratio.
You can also enable the rule of thirds guides in ACR. In the same drop down menu that you set the aspect ratio to 2:3, scroll down and select "Show Overlay".
You can also set a custom ratio in ACR. For example if you want to print a 11" x 8.5", set it to those dimensions and then select Inches for the crop
