sigma 17-70 constant f/4?

since i switched to my tamron 17-50, i left my 5-year-old 17-70 at home most of the time.
now whenever i attach the lens to either my 50d or xt, it does not let me to use aperture higher than f/4 (2.8-3.5).. and interestingly i can use f/4 at 70mm :lol:
anyone experience a similar problem before?
i'm thinking about sending it to sigma.. but to avoid shipping cost and since i'm soon heading to hong kong and there has a sigma tech office, will they fix this sigma(usa) lens for free?

Isn't the Sigma 17-70 a f/2.8-4? So its supposed to be f/4 @ 70mm and f/2.8 at the wide end of 17mm, don't have experience with the lens, but would guess it would hit f/4 around 55mm onward... so below that should be able to open up wider.

The old version is 2.8-4.5, and that sounds a bit odd, I'm not sure about the Hong Kong office, I suppose it wouldn't do any harm to just give it a try, then if they say no, send it when you get back?
