Lawsuit over Pictures

The litigious nature of our country drives me crazy. The hospital tried to offer comfort to a mother who lost a child, and for that effort they are being sued.

Maybe they sent a few to many pictures, 154 according to the story (yeah to many), but really worth being sued over?

Whether or not she should sue asside, taking over a 100 pictures of a dead baby does sound a bit disturbing. I'm sure they didn't mean any harm, but it doesn't sound like the hospital really thought this one through.

Quite honestly i would have sued as well... I know i would not want to see pic's of my dead child and sit their and think about the way they were handling the infant during the time. Definitely not thought out well by the hospital.

I agree that the hospital went too far -- they probably thought that the mother would *want* that kind of thing, but she said she didn't. And to "pose" and "play" with him so much? Very morbid and disturbing, frankly. (It could have been an overly-enthusiastic photographer.) It should be a simple form for the parents -- yes or no.

If she asked for photos to not be taken, then the bereavement team was at fault for not listening to the patient's wishes.

i dont get why they would sue over it. seems if anyone is unhappy over there they just "sue" the person they feel is responsible for their unhappiness (is that a word?)

You mean down here and yes were Americans we sue. I would sue the pants off of that hospital if they flopped my dead baby around and posed him in multiple outfits and poses. I can think of no reason why a hospital would ever do that unless it was requested from the parent and even then, its completely inappropriate.

However disturbing taking 100 photos of a deceased baby may sound, if the mother signed any photo waiver that allows the hospital to take photos of any kind from x-ray to digital images, then the hospital has legal rights. If she didn't, then that calls for a investigation and eventually a lawsuit if it falls within the boundaries of the law(s).

To me, hearing the descriptions of played with like a doll, dressed, redressed, etc is quite likely just positioning and clamoring by the plaintiff in the case. I am hard pressed to believe that the hospital staff and photographer taking the pictures were playing with a deceased human like a doll. It's also possible that there were mixed messages, or conflicting signals. It's anyones right here to file a suit, and without all the facts from both sides it's hard to take a side.

If someone was defaming a corpse that's grounds for arrest, or other action, not for a lawsuit :\ Then again, I'm not a lawyer so...

Maybe the hospital was trying to do something similar and give the family a beautiful memory from a painful and heartwrenching situation.

Maybe the pain of losing her child will magically go away after she gets her money from the hospital.

In 10 years time, when the pics are the last physical memory they have and the money's gone, that will probably be when they'll understand the full meaning and truly appreciate the photos.

it seems like money and greed makes up for peoples grief...and people who see opportunity to make a quick buck over someone elses tragedy is genuinely lower than a bottom feeder. It so sad that in US, so many people abuse the system.


No I'm not a photographer, I just shoot with Canon DSLR with those lenses with red thingy...;)
