Came across a recent Fed appeals court decision, reaffirming the public's right (not just journalists) to photograph police activity in public (with reasonable limitations):

Whether a suit for unlawful arrest would be successful--which turns on whether the police activity occurred in a state where a federal court has clearly held such arrests unlawful, and thus qualified immunity unavailable as a defense for police--was the focus of the case. However, the right to photograph (and audio record, despite Mass. state statute prohibiting it) was deemed basic.
