I think some cops are just paranoid about doing something they shouldn't be doing and having it caught in pics or on tape. Any cops that give a crap about this are probably the ones that need to be watched.

Talk about a violation of constitutional rights. Since when do police have a BFA in photography? This is basically "If you take a picture, we can arrest you."

Similar situation... A Long Island NY videographer was arrested by a Suffolk Co. police officer for filming the aftermath of a police chase. The officer claimed "obstruction of justice" and arrested the videographer even after he moved back a block. The charges were eventually dropped by the DA and an investigation ensued, but no less he was still arrested by some cop playing cowboy with his power.

if an officer came up to me and gave me some crap, i'd stop taking pictures (i'd be too mad and that would ruin the mood) and then i'd have some choice words with the guy.

For all of those screaming "violation of Constitutional rights," this is nothing new. Stupid, yes, but nothing new.

See cases on obscenity for the same definition. The problem, of course, is simply who makes the judgement as to what is "aesthetic value."
