Hello,

First the background story:
My daughter started horseback riding lessons recently and I obviously had to bring the camera to take some shots. The owner of the farm saw me and asked if I could send some pictures her way since she "probably needs some new ones for the website". I kind of laughed it off at first but started to think about it recently.
For the quality I am producing now I wouldnt expect big bucks from this but if I could barter with her for lets say free lessons for my daughter I would be happy, but thats not really the issue here.

I have been shooting mostly my daughter and horses alone but I have snapped a few of other riders. If I did decide to give the owner some pictures would I run into any issues with people or their horses who are in the pictures? I am aware of things such model releases but not sure what my rights would be in this situation.
If it is a problem I would refrain from shooting other people or simply not provide any of those photos to the farm owner and it wouldn't be a big deal. I am just curious.

Edited to add:
I did read the sticky about Releases but have not found the answer to my particular situation.

I hope I am making sense here. ;)

You can give the owner any photo you desire. If she decides to use it on the website, she will be responsible for getting the release from the individuals and property owners in the photos (make sure you explain that you do not have any signed releases when you're selling/bartering with them)

Thanks Jason.

so it would be her problem because she is the one displaying them on her website (using it commercially), and I would be off the hook even though I am the one "selling" her those photos (and technically profiting whether its cash or trade for her services)?

If you are licensing the image for commercial use, it is best to have a release signed. You own the copyright, you need to be sure that you have the permission to use the likeness of the subject. If the image was to be used editorially on their site, as in an article you should be fine.

It wouldn't be commercial use as in billboards but your typical business informational website "here is Jack our 10 year old stallion and here he is jumping with Nancy".

Use your judgement, it can be vague.
I suppose if you license the image for editorial use only you may not be held responsible if the client uses the image commercially.

I guess I should just focus on shots where this would not be an issue just to be on the safe side.
I would hate to get in trouble for something I didnt even get paid for. LOL
