Is there a federal law or something that requires them to have a W9 on file for any photo rights that they purchase, even if that photo was not taken specifically for them?

It's my understanding that W9s are for freelancers and contractors, but if they are essentially buying a 'stock' photo, then whats up with the W9?

I'm not an accountant, but yes it is to cover their but. If they are paying you for anything they'll want a W9 from you. I assume there is a threshold when they actually have to report your earnings via a 1099, but this form will tell them if you are subject to backup withholding which is what they are really after. If you are subject to it you'll have to inform them as such on this form. I think that is what they are really after.

Thanks, that clears the fog a bit, but selling a photo not shot for them doesn't make me a contractor/freelancer in my mind.

No matter who you were working for when you took the image, if any company pays you over $600 per year, you will/should receive a 1099. The W9 will give them all of the information they need for the 1099.

This was a one time sale of a single image, not taken for them, and sold for far less than $600! :confused:

Look at it as good news. The haven't completely ruled out the possibility of spending over $600 with you this year :)

I shoot for a lot of teams only for one game that is less than $600 but they still require it sometimes, not sure why since it's not the law, but they do. Also have had some companies buying stock do the same, most wait to it's over $600 but others don't, not sure why. Not a law but more of an internal accounting practice.

The federal threshold is $600 but a 1099 can be generated for any amount.
