Taxi ran over my 50D

It has taken me a couple of weeks to get over the shock - a taxi ran over my camera bag a couple of weeks ago and broke my beloved 50D. Amazingly, the lenses in the bag seem to be ok (my 24-105, my 100L macro, and my 70-200 4 IS with the extender on!) and more amazingly, the 50D still seams to work! (+1 for that metal body.) But the top lcd screen is broken. Because it's out of warranty, it will cost at least $199 for canon canada to repair it. And I'm not sure if there is anything else wrong besides the lcd screen.

The 24-105 was on the camera but it seems ok - I tried it on my 20D and it focuses, zooms, etc. It had my cir polarizer on and it's broken (won't turn anymore) and one uv lens in the bag was broken. But it could have been a lot worse.

Anyway, I'm trying to decide if it's worth sending in when I can get a used 50D here in like new condition for $600 to $700. I'm dealing with the cab company who should be putting in a claim with icbc but I don't know how long that will take...

Is it actually the LCD broken, or just the glass covering it

I saw somewhere that a new cover for the LCD (if it is just the cover, hopefully....) comes complete with ready fitted adhesive mask and is not very expensive at all ($10US or something) - I think that was for a 7D, but can't see it being much different.
You would have to fit it yourself of course - the old one just pulls off.

There is a big black blob where the ink used to display the setting is smeared all over, and none of the settings show up except the battery usage and the exposure scale.

What I'm curious to know (probably like a few others) is how the taxi came to run over it in the first place.
Why is the taxi company responsible?

curious to know also and like he mentioned If the taxi was at fault was he not insured? Or would your home owners insurance cover it I know mine would..look into that you might just get a new camera outfit minus the deductible that the taxi should cover...either way would love to hear the story behind the taxi?

Something tells me that, getting run over by a taxi cab, is not covered by the factory warranty. Sorry to hear about your camera, and good luck getting your situation sorted out.

The taxi driver rolled forward as I was getting out with all my stuff, and his back tire ran over my backpack. The cab co says they will file a claim with icbc (BC auto insurance) as he admits it was his fault. But it's been 2 weeks and they haven't filed yet. My insurance will cover it, but my broker and I agree that it shouldn't have to come from my insurance. Plus if I file I lose my "no claim discount" on both the camera rider and the house insurance - that is 15% for 5 years. For that I should be getting enough for a new 7D!

Wow, sorry to hear about your poor camera! Crazy! At least your foot didn't get run over or something. (Maybe that would've been preferable??)

Do you have the acknowledgement from them of liability in writing or email? If not and they are dragging their feet, then I'd really press them to get that to you!

I don't want to appear unsympathetic, but putting a backpack where it could potentially be run over is just asking for trouble.
Unless the taxi driver put the bag on the road, which doesn't appear to be the case, it wasn't the cabbie's fault.
Unless it was on the footpath (sidewalk) and the cabbie drove on to it, why should the cab company be responsible for where the owner of the bag put it?

Still not sure how the camera bag ended up in the path of the wheel because that sounds like it was under the taxi, but in the hustle bustle of getting everything out of the cab I can see it. If the cab was in Park it wouldn't have been an issue. There's "blame" on both sides.

You could ask them if they'd be willing to give you $200 and call it a day. Worst they can do it say no.

Well, you have a point, but I don't know that it's a cut-and-dry "right" point.

I'd say if you are in the process of getting your belongings out of a cab then you have a reasonable expectation that the cab would not just drive forward. In fact, what if the damage was something like a broken foot?

I'd say the fact that both the driver as well as the company took responsibility for the incident should pretty much seal things...
