I'm guessing a Merlin of some sort....don't know them well nor have I photographed one before but it looks small comparing it to the fence.

I'm leaning toward a juvenile Red Shouldered Hawk, page 130 National Geographic North America field guide

Thanks, He flew right up me as I shot it with 24-105 lens. Just was not looking for one so close to the coast.

I would say either a Cooper's Hawk as previously suggested or a Sharp Shinned Hawk. They are very similar with the Sharp shinned a tad smaller and a having a slightly different flight shape.

This is not an Accipiter (Sharp-shinned, Cooper's, or Goshawk) due to lack of a yellow eye (since this is a juvenile bird; it would be lacking a orange/red eye if it was an adult). It has a brown eye, so it is a Buteo. Most likely a Red-shouldered Hawk.

Evan has suggested the correct ID. Juvenile Red-shouldered Hawk.

It's a beautiful hawk, for sure. Great shot.
