This was taken early morning before sunrise. That would explain the light color background. Tried to bring out as much color as possible. I am not completely sure on the ID.

Looks like a Merlin.. They are just a tad larger than the American Kestrel. Love the tail fanning :)

I see the difference in size now that I am looking at some of the samples online. For some reason I thought that Merlin's were a much larger bird.
