Liam is correct - as I stated earlier, you need to ask about the reasonable expectation of privacy.

If a work is being sold and you're sued for it, the court is not going to dismiss your case because you photographed the private property while you were standing on public property. The court is going to ask questions like did the property owner have a reasonable expectation of privacy from being photographed and if the photographed is being used in a way that violates the property owner's right of privacy or other ownership rights.

Here's a hypothetical: Say you own a private home and it is very recognizable - it is the only bright yellow house in South Boston on X Street. A foreclosure law firm hires a photographer to take photos of houses in South Boston for use in their brochure. The photographer is standing on the public X street and thinks that the bright yellow house with the for sale sign a great subject to submit. The law firm sees the photo and thinks it's great and starts to advertise their foreclosure services in a printed brochure, in newspaper ads, and on their website. You open up the paper and you see your house in a foreclosure ad - you get furious... this might impact the true sale of your home as people drive by the home and say, "Didn't I see that house in the foreclosure ad? I don't want to call that listing."

All I'm saying is that the use is important and there are specific circumstances where the copyright owner could get into trouble. 99% of the time, you're right.

Public domain basically means that copyright law does not apply. I'm sure that's not what you meant.

Yeah, pretty much - I thought I alluded to that when I suggested 'if you try to sell for commercial purposes or in a position where you get paid for use, it's a good idea to go and meet with the owner of the property and negotiate a usage fee' prior to making any deals.

We weren't disagreeing. Not sure why we had this back and forth, except for some vague phrases and slightly different legal meanings in words used.

I like it. What kind of poster are you contemplating?

Could you not redo the same shot? Straighten the head, make the background the same (lighter colour) so you get that nice disconnect, and a little extra flash fill for the eyes?

I guess maybe not poster, something like a 8x10 or 11x14 to just have at work.

The picture was taken last summer at random on the Red Line so a re-do couldn't work.

Hmm good question, I didn't think of it in a way of a "statement" but more so as "I like this picture hanging somewhere"
