Hi Folks

Just finished writing my wedding contract, but not an expert, so not sure if it's ok or not, and would really appreciate your opinions.

I think that you are trying to cover too many bases in one document - is this a set of T&C's, an order form or a sales document?

Let me think on it for a bit and I'll post some suggestions.

I haven't dug too deeply looking for gaps, but I'm left unsure about one thing: suppose the client makes substantial changes to the plans, e.g. a different venue, city; or the wedding party has grown from 50 to 400 ? There's nothing beyond your control here (you can commute, adapt to shoot a larger party) and they're not cancelling or defying any portion of the contract. So it looks like you have to be a "super-accommodater" - I'd leave yourself wiggle room to (if certain critical info has changed) attempt to renegotiate the terms or withdraw services in the event an agreement can't be reached.

Viewing: You first say the images will be completely edited after about 2 weeks; then you say you can't promise that. Also: what if you return the images after 6 months ? What recourse does the client have ?

Copyright: I'd invoke the language of licensing. Poke around here (external link). I wouldn't be as concerned about intent as I would be about the effect. ie. if they are being used commercially, the intent is irrelevant to me.

The "infallibility clause" under Creative Licence comes across as odd, no ?

"I have deemed that 2 photos was the correct number of photos to haven take at your wedding !"

In all seriousness, what is their recourse in this admittedly loopy example ?

You need to add a severability clause, something worded like, “in the event a court of law rules that any section of this agreement is invalid, the remaining sections will remain in full force and effect.”

Thanks Chris, do you have any ideas how I can word that point any better? As for instance, if the finished files were delayed for one reason or another beyond my control, I'd rather not be liable. Obviously I intend on delivering files on time each time though, but just in case, I wouldn't want to be legally left wide open.

Complaint procedure? Might lead the client to believe there will be problems:)
Customer service and follow up will eliminate the need for a procedure clause.
