Falcon ID Poor pic's

Think this may be an impossible task but going to ask if anyone can ID. Small hawk/falcon about the size of a coopers. Has been a Peregrine sighted in area off and on this winter.
Just walked out of tree shaded area on beach into sun when it took off and didn't adjust camera for bright light.

I can't tell. We've had both peregrine and merlin near Lake Seminole.

This was taken on East Beach at Ft DeSoto this morning. It flew out over the bay pretty quick.
