Subpoena the image file used by the defendant and see what date it was created. My guess is it's post 2007 not 2003 as the defendant claims. After paying their own fees no one really won.

Agreed, but I think it might have been more a matter of principle than of dollars.

That said, the judge's decision and reasons bear thinking about, especially for Canadians.
