Looks like it. It's not scaled the same, they squished it some, but I got it to overlay and it sure looks like the same one.

Definitely the same photo. All the pedals are in the exact same position, and all the heads line up. Even someone shooting right next to your shoulder at the very same second would have a slightly different perspective on the grouping of heads.

Flat out stolen. :confused:

Well, I never expect my photos to be stolen and used by a large organization..that's because I don't shoot a lot of high profile races. I didn't register the shot and the shot was taken last year. I just let it pass. I am shooting this race next week. I will make sure with my pro photos I would have my watermark right dead center and brightly visible, 100% opacity. :) They are smart. The poster isn't in high resolution and so many imperfection can be passed.

Also, I see if they would give me a media pass on the day of the race. Not that I need one to shoot but at least the race marshals won't give me problems. They gave me one last year. If they refuse or I sense that they don't take my request too kindly, I just bring up this little incidence we have here. :) See how that would go....:)

Statutory damage? So, what sorts of statutory damage I am dealing with here if I decided to pursuit this after the race? I have already saved the poster image and probably keep few copies of the flyers on the race day. BTW, this poster wasn't up on the site until maybe 2 weeks ago. At first, I didn't pay much attention to it. However, the shot looks very familiar at first and I thought they used the shot from another photog.

If the image is not registered, you can collect fair market value + DMCA damages.

If the image is registered, you can ding them for damages, DMCA + court costs.

Write and ask them if their sponsors would be happy with copyright theft? We had to take on a really big company in this country, who took no notice of us. So we wrote to their sponsors, who in turn wrote to them. You will be surprised at how quickly companies can back pedal!

Good idea. However, I am still thinking if I should take actions now or after the race. I hate to bite the hands that feeds you. :)

Great shot. I see that they've already got a link to your work, so you can't use that angle. That's a big deal race, being USA Crits and all.

I scratch your back, you scratch mine.

There must be something that you'd like in return (other than cash which might be hard to get).

Parlay this into some sort of working agreement? I dunno.
