ERROR 99 - 40d - Different...

I know, yet another Error 99 post about a 40d, however after reading through the other threads, mine seems to be a little different.
Ive had my 40d for about 2 months now after buying it on ebay (replacing my 350d which died of, you guessed it, error 99)
I had it appear today whilst shooting a tennis tournament (of all times for it to fail). Ive tried everything suggested all over the interwebs, but to no avail.
However, when on Live View silent shoot, it works!!
Live view on normal shooting it doesnt, however when on silent mode 1 or 2, it does!!

What does this mean is wrong? the mirror? shutter mechanism?
Ill get it repaired, but i just thought it would be interesting to know what you guys think,

you say you'v done all the norm things ,take all batteries ( main and button ) out and press the shutter for 30 secs this will do a hard reset of all the settings in the camera ,have you done that ?

Yup, done all of that, and replaced with a fully charged battery :/

update the firmware to 1.1.1 think thats the last one ?

I already updated the firmware about a month ago, from the link you gave me. Even then, i think its a hardware fault, not a software one

Yup, had to reset the clock, and i did an in camera reset aswell which cleared all my c.fuctions

looks like its time for a new shutter, as with the live view the shutter is open then closese and open to take a photo , do you get the same thing in full auto mode?

As far as i know, you cant do live view in full auto mode

I'm in the UK, and the CLP is US only :/ looks like ill have to fork out a £85 service charge at my local store :/
