my image attributed to another photo company by a magazine

So there is this magazine here where I have been advertising over last 6 months. There have been times where I have worked with this magazine on barter terms i.e. bigger advertising space n stuff for some shoots and event photography.

They had asked me last year if I would be interested in doing a calender for them in barter. As I was busy with work I declined. Now today I saw their new year edition which was accompanied by their 12 page desk calender. Its primarily been done by two other photo companies.

On one of the months they have this main image done by another company and its credited to them and on the other side with the calender dates they have used one of my images from another session not associated with calender. and they have credited it to the same company.

Its not that they didn't even care to inform me that they are using it or they used it. My issue is that its been credited to another company,

i am just stopping myself to send out an email immediately to them of violating copyrights so that i am more sane in writing to them.

what would have you done in this case? remember my pain is with this big sign next to my image which is of another company.

I can see how something like this would drive a shooter to insanity.
You should have the director of the company and all the staff lined up and shot at dawn for making a mistake like that!

It's probably going to cost you millions and the rest of your photographic career!
At Least!
Don't hold back, send them an email and carry on a treat about their violation of your human rights... and copyright. Puff and blow and threaten and curse their worthless souls. Tell them you will never work for them nor accept their money ever again after this unfathomable violation against your very being.
Tell them you are going to sue their worthless arses off unless they compensate you fully and promptly and let everyone in the world know what they did to you.

That ought to shame them into immediate action.
With a bit of luck, you should get full and complete compensation inside a couple of hours.

Any idea what you will spent that Hundred bucks on once you get it?
Maybe therapy?

Of course there are always 2 sides to any story. so spare a thought for the poor guy that has been credited with your work and how he must feel when he ISN't responsible for your pic but getting it hung on him just the same!


From RDKirk: First, let me check the forum heading...yes, it does say "Business of Photography" and not "Hobby of Photography." Okay. So we're talking about making money, not about hobbies. By "business" I am presuming activities that pay expenses and produce a profit over the long term.

lol you made my day,
feel so good now, back to work.

will only send a note to the magazine just so they don't do this again
we are paying 500$ every month to them for a quarter page advert.
just stopped advertising with them

You're in Dubai & I'm wondering what country the calendar company is in, & does Dubai subscribe to the Berne Convention (external link)
And did you have a watermark on the images? Were they registered?

The first person I'd talk to is Carolyn E Wright. From Carolyn E Wright's blog: (external link) Section 1202 of the U.S. Copyright Act makes it illegal for someone to remove the watermark from your photo so that it can disguise the infringement when used. The fines start at $2500 and go to $25,000 in addition to attorneys' fees and any damages for the infringement.

yep I am in Dubai and so is the company.
We have stopped our advertisement activity with them.
Images were not watermarked.

The Berne convention and the US Copyright legal system are entirely different.

If you pay 500$/mo for a 1/4page, then you should seek compensation of 2k$, i would also seek mis-creditation fees, the price of 2k$ would be with credit to me, but since i am not credited the price would be higher.

It honestly sounds like some chump made a mistake in their libraries, but it might be they tried to pass it under the rug, in both cases, business isn't personal, you pay them, they should pay you. Done.
