Billboard Mag trying a rights grab

It seems that Billboard.biz announced today a revamp of their Backbeat area. They also stated that the simple use of the #Backbeat hashtag gave them full rights to use a photo posted on twitter editorially with no other permissions or compensations.

I think Billboard, who should know better, screwed the pooch on this one. I can't see it standing up to a court battle either.

The simple problem is that magazines and musicians have lawyers who will back them up in a court of law, photographers can't really afford to unless some rich photographer dips their hand into their pockets to bring this case to court to see if the magazines and musicians have this "right", even if they did, I doubt if they would this

This is what magazines and musicians are playing on, they think that they can do that, and there are fantographers who would sign away because they don't want to "exploit" the photos i.e. kiss their a**
