Lens got lost in transit.

Hi and how is everyone doing? I am not sure if this is the right forum to post this but just need some advice.
Last week I bought a 40mm pancake from another member, he shipped the lens on Tuesday and I was suppose to get it Thursday but nothing, I contacted the seller Friday night to see if he knew the tracking number, he gave me the tracking number Sunday. And it appears the the package got accepted and thats it no more tracking history. The seller contacted the postal service today and he said that they don't know what happened to the package but that they are sure it's no there.

Has anybody experience this? What do you think I should do?

The question is if the package was send to the correct address. What is the tracking information detail? Of course, is this a new or old member? What about the seller's feedback if any? Were you home when the package was supposed to be delivered?

I checked the tracking history myself and it only shows the time the package got accepted and that's it. I am trusting the seller at this point. And of course I used paypal gift :(

Ask the seller for a copy of the receipt. The receipt would say where the item is being shipped to and at what day it would be expected to be delivered. You need to know if the lens was shipped to the correct address. Two, making sure he seller isn't trying to scam you by giving you a different tracking number of another item he sold and sent out.

I did. I also bought a 7d on Thursday and got it Saturday!

Seller just send me a refund for the lens.

I'm fairly sure that from a legal POV, if the lens wasn't delivered then the seller owes you a refund. They then have to get their lens or their money back from the company that they had a contract with to deliver the lens. Of course if they didn't select a service that includes insurance their contract with the post office/delivery firm will almost certainly leave them SOOL.

If I were in the OPs shoes, and all the facts are true, I would not split the cost with the seller. Why? Because it's the seller's responsibility to insure an item so they are fully covered until the item is delivered safe and sound. If they don't insure it, then they have to accept the loss if the item is never delivered. Insurance can be pricy, but it's a gamble or calculated risk if you choose not to get it.

The buyer has no financial responsibility until the item is delivered without damage.

priority mail is not guaranteed. so you'll have to wait like 30 days before you can file any claims.
also it's called delivery confirmation, not tracking for a reason.
and for online sales it's the seller's responsibility to get the item to the buyer unless agreed to beforehand.

I understand. And on a big ticket item, I'd agree; it would have been insured, and the sellers responsiblility, worth the investigation, and so on. A new 40mm 2.8 can be had for under $150, in fact for a while, closer to a $100*. So what's a used one going for? I'm going to assume it wasn't insured. It could have been delivered and stolen from the door step. He bought it from another forum member; I'd ask if it was, or wasn't insured. If not.... just me... I'd split it.

*Best Buy if using Master Card.
