I should have realized it wasn't the restaurants that have the problem, but the over-bearing customers.

I don't know what restaurants you guys go to, but I've personally never been to one that had every customer taking photos and creating a "flash-a-thon".

I'm also going out on a limb and suggest that you probably have an extraordinary sensitivity to white light, because personally, when I am concentrating on eating my food and talking to whomever I may be there with, a led light over in the other corner is of no concern at all (considering the light is pointing down towards the table).

You guys, seriously, over-acting much!

Like I said, a little bit from a P$S or a cell phone can be rude, but having people shoot with a DSLR?

Ok, I'll concede that a dslr is a little over the top if their main reason for being there is the meal/night out.

But what if I don't like the way you hold your fork, or the way you sit on your chair, or any other manner of things! Do I head over and have a chat to you about it, or do I just get over it and enjoy my own time there?

Yep. And I am allowed to decide to dine there, or not (private belly).

Capitalism. It's a beautiful thing.

yes it is, so they must realize there are benefits that outweigh to negatives to this sort of rule, a big negative being no more free advertising on social media by the customers!

That's a whole different scenario from someone firing off a flash "in your face"!

Could it be the restaurants don't want their methods of dish arrangement given away? I don't know how protective they could be, I am a pb&j kind of guy...

There's a big difference. You might not like my table manners, but they don't affect you unless I'm sitting at your table. If I suddenly shine a light in your eyes from the next table, that does affect you. It's intrusive. It barges into your personal space.

A similar annoyance in restaurants is excessive noise. If a party of diners is so loud that you can't converse with the person across from you, it's too loud. Way different from posture and fork-holding style.

So here's a question. If a musician and an actor and such have copyright over their "image" and can control the photos people publish of them, and if a sculpter can control the image rights to photos taken of their work, is it not the same for a chef to control photos of their creations?

Hmm!

I'd say if you take a Big Mac out of the bag and put it on the plate and photograph it, no problem!

But keep it in the bag so the brand "shows", then, Problem!

Let me give you a scenario: you're in a small (converted Victorian era townhome), intimate restaurant with you spouse, enjoying an exotic, expensive meal and the guy next to you (only 12 or so tables in the whole joint, two or three per room) is standing on his chair. What's he doing? Looking down at the table with a DSLR and speedlight trying to get "just the right shot" for his blog. Talk about killing the ambiance.

Better yet, you're sitting in your chair when you feel a thud right in your back. The @$$hat behind you has slid her chair into yours in a vain attempt to get "just the right angle" to shoot her meal. Meanwhile she has also blocked the route through for the server who is standing there with a tray full of food waiting on her.

These situations are becoming more and more common unfortunately.

They can certainly try, but unless I sign some heinous release, they won't be owning copyright of any photos I take of their "image."
