How do you handle a demand for "publishing rights" when renting a location?

Lately I've been running into this issue. I'll pay $500+ to rent a venue for a shoot, but the venue will demand "publishing rights" to all pictures taken at that location in addition to the venue fee, which I assume means to them that they can do almost anything they want with my pics, short of reselling them.

I always say no, that if they want venue pics they can pay for them, or give me a discount on the shoot for use of the images. But lately I've been getting a non-negotiable, all or nothing stance.

How do you handle such demands? Do you not care and turn over the pics? Only turn over pics with a huge watermark? Do you walk away from the venue? Or do you try to negotiate?

I'd tell them no and find somewhere else to shoot.

I'd find another venue. Let them know the exposure they WOULD have gotten is not happening due to their "demands".

I have yet to pay for a venue to shoot in, let alone pay for it and hand over pictures. There are plenty of places. If the client wants it bad enough, pass the cost of the venue as well as the publishing rights onto them.

I've never heard of such a thing. I'd walk away...or I'd give them a contract showing my fee for commercial images minus the fee they're charging me and ask them for a check for the balance up front.

Discount, hello, the economic value of this images will significantly exceed the economic value of the venue. They'll owe him money.

I have a "smiley code" on my forum that consists of a middle finger shadow-masked over a nuclear explosion for just such demands. :D

(Yes, IMHO such a demand is nuts.)

So just to make sure I understand this right, they want you to pay them so they can use your images as advertising?

wow, never heard of such a thing. this sounds totally ridiculous to me.

it's like I am charging you for cooking yourself a meal from your products in my kitchen, but, as a bonus, asking the rights to come to your place later and have a meal from your fridge for free.
