I reserve the right to have any photo retouched by James (Dexter's dad and my brand consultant) before posting.

James --> Ex, brand consultant (manager)
Dexter --> Her's and the James' son

Thanks for the feedback everyone.

Jimconnerphoto does make some great points, but I still can't get past the fact that someone would be going over my work, that I put my blood sweat and tears into, spent time post processing time on, and then add their own spin on it. I mean... at that point, what is the point of me even taking her photo?

I wish she had brought this up before, then I would’ve been more open to working “WITH” her retoucher and coming to some sort of prior agreement. This shoot has been pending for 2 months now.

I wrote her a polite and professional response back, letting her know that I am very excited to work with her, but I cannot agree to allow someone who I do not know, who's work I've never really seen, to retouching my images at their own will.

We both agreed to work together creatively because we both trusted in each others talents. Trust doesn't involve someone else having say in what parts of my work will be published or changed in order to be on her website.

I think most people called it: Walk.

I did leave the ball in her court. If she can be flexible on her terms, we will shoot this evening. Otherwise, I will just cut my losses and move on.

My integrity is worth more than just handing my work over to who knows what.

You guys rock, thanks again for the imput. This one really threw me for a loop!
I've dealt with all kinds of model crap over the years but this was a new one for me lol

2. I reserve the right to have any photo retouched by James (Dexter's dad and my brand consultant) before posting. He does this free of charge but needs to receive credit for the retouching on any public display of the image.

This is my deal breaker. I would walk.

It's not unusual in a commercial situation (and TFP is a commercial situation) for the client (the model in this case) to retouch and/or manipulate the images.

But if I read the OP correctly, this model wants to retain permanent authority to approve the photographer's future use of the images as well as to prohibit the photographer from doing his own retouching and manipulation.

Obviously, that's not acceptable.

Walk away, if that's the requirement.

That was my beef with it too. Based on the tone of the message in the OP, once you deliver the digital file, they're going to retouch it whether you agree or not. But, assuming I get a model release before we start shooting, the model can't tell me which of my images I can display and which ones I can't.

eh, I would probably pass - not necessarily because of the specifics of that agreement, but because the whole tone of that message just screams "unnecessary drama, do not want."

Well, she backed down and apologized...said she totally understood.

I will have her sign MY model release this evening, and hope the drama ends here!

I just want to make some fun art! :)

Kristen=1 James=0

LOL Congrats and glad you got what you needed. I think it would be one thing if you were getting paid for your photos and licensing and that a professional company was changing the images for their commercial use. Something different for an "EX" to be damanding credit and the ability to manipulate.

There are tons of models out there. Don't waste time on those who put ridiculous conditions on you.

My reply would be "I would agree to your terms in exchange for payment of $5000. We never agreed to these terms before. If these are your "usual" terms, why did you wait for the day of our shoot to spring this surprise?"

so I just read the whole thing, sounds like soap opera.
Did the shoot ever happened? did she bring her "ex" and were you supervised?

So what happened? That sounds like a ton of drama and I'd never do that! I stopped taking her seriously when she sent a "text message" with her "conditions" that started with "hey babes" and then laid out that she's a single mom still working with her ex! Not to mention she laid all this out the "day of".

Not professional on her end. And no telling what seh'll do with the images lol

Sounds like a normal day at m0delm@yhem.

Is "single mom" her brand or her image? Too funny.

Unless this was britney spears or similar, I would not agree.

But jokes aside, personally I don't allow retouching unless I really don't care about the image.
