This is Canon's stance on warranty on private sales.
If you have the original receipt an it was not registered to another person then it would probably be fine. I can't imagine a gift not being eligible for warranty purposes, unless the item was part of a "Kit" purchase then parted out.

Canon EF and EF-S lenses purchased in Canada or the USA (from a Canon Authorized dealer) and delivered to you in new condition in its original container, is warranted against defects in materials or workmanship for a period of one (1) year from the date of original purchase within North America (only valid in North America - unless otherwise stated - i.e international). This warranty is not applicable for purchases made from one individual to another as the warranty is NOT transferable.
