What is required for law enforcement to enter private property? What is required for a private citizen to enter another private citizen's private property? Law enforcement need one of those nifty sneak and peek warrants.

Even if you are illegally trespassing, your photography while trespassing is legal. Canon [7D & BG-E7 grip] [T1i & BG-E5 grip] [400mm f/5.6L] [50mm f/1.8 II] [18-55mm f/3.5-5.6 IS]

Even if you are illegally trespassing, your photography while trespassing is legal. The topic was not whether the act is currently legal, but whether the law making it illegal would be overturned in the courts. Since privacy laws are state statues, the state may choose to define additional protections in its privacy laws, including the privacy of agricultural businesses in their place of business (which are not normally open to the public), and they may choose to make lying on an employment application for purposes of conducting surveillance illegal. I don't know why such laws would be overturned by the courts. That's all I was originally saying. Tom

But, the issue of whether or not the photography is legal is a federal, not state, issue, and has already been settled Canon [7D & BG-E7 grip] [T1i & BG-E5 grip] [400mm f/5.6L] [50mm f/1.8 II] [18-55mm f/3.5-5.6 IS]

Someone gets caught doing something bad, so they lobby to make the act of catching them doing wrong illegal. Some areas even make it illegal to film police officers on duty. However if you go on Youtube and look for people getting busted for that, most times they are asking for a problem anyway.
