Tamron 70-300mm VC Focus Issue

I bought a Tamron 70-300 off this forum and it has a focusing issue. It's really slow to focus, some times it does not focus at all. not sure what's wrong.

The lens is still under warranty, but I am not the original owner however I have the receipt.

Will tamron still look at it and will it be covered?

The lens is slow at 300mm in low light.
