previously i noticed tonight my camera was set in AI focus. tonight I moved it to ai servo before shooting. as I mentioned it seemed to have problem locking AF on fast moving subjects prior to the "lock". could my camera have an issue with AI focus mode?

AI-Focus is not a mode. It is a state where the camera decides which 'real' mode to use, AI-Servo or One-Shot. The decision-making time slows down focus. Choose the 'real' mode that suits what you are doing. I don't know anyone who actually uses AI-Focus. That may help.

Buy a new battery & small battery.
Pull both, hold down shutter to release all electricity, and leave off for 24 hours.
Install new battery, small battery, and inspect all the pins in the compact-flash area to make none are bent. Format compact-flash card or get a new one.
Check the door on the compact flash card as there a sensor that will make it go wonky if something is wrong with it.
Clean contacts on the lens and camera.
Install old firmware.

You may need to get the shutter serviced. It's not very expensive.
The only thing that is expensive on these cameras is the sensor.

Thank you and I was not intentionally using that I probably bumped it with my thumb at some point. I also find myself bumping the aperture with my thumb at times In error.

Black screens sometimes happen with bad firmware, aka magic lantern or some corruption.

So nothing appears on the lcd at all? No function buttons or anything turn it back on?

I re-read your initial post. Double check the pins. It may have bent and blown a fuse on the power pcb board. That explains the battery discharge.
But... this isn't something that would happen intermittently.

I know this is why it's strange.

It has happened when I shoot the shelter pets. they move quick b/c they aren't the most tame, I go outside in a pen with them to let them run. Intermittently the camera has a hard time locking focus on them moving fast. Looking through the viewfinder i can see the lens isn't locking it. That somewhat makes me question the lens but I also get tack sharp pictures so maybe that's just me.

It always "locks" when I am shooting bursts, towards the end. click click click click, and i can hear it on the last time, because when you push to take the picture once, it's a particular sound, but when it locks its as if the sound is cut in half. I see only black through the viewfinder. Then I take it from my eye and the LCD is also black. The red button indicating "write" is on, but it's not flashing, it's just solid red.

At that point it's just black and I have no way to control it but to shut it off. No function buttons work. The only thing is to turn it off.
