What the article should say ...
Photo Copyright law is out of control since the invention of internet almost impossible to enforce.
Theretofore send a letter for reimbursement / credit ... and Good Luck with that one !

Yes. Thank you for sharing this OP. Def some good info. but when I got down to the last one, I couldn't help but feel a little funny about it. So one year later he's still sending the guy demand letters for a few hundred bucks? Couple that with the "I make a living from this" and it comes off as a real "small scale" guy hurting for money.

Gosh darn I think the offender would laugh at that. Not that it's right (because it's NOT) but I just don't think folks who know they are doing something wrong would have any respect for it. It comes off so desperate a large company would immediately know that he won't have the $ to get an attorney and do anything about it.

Unless it's a person who is believed to be doing it unknowingly (as sometimes happens with the everyday joe… someone just didn't know the law), it is far more professional IMO to have a lawyer do it from the start or do nothing. The one thing about having an attorney do it it says "I mean business" and "I have the $ to get an attorney" and "I am willing to go there".

I would use these letters for personal requests, like for a non business person, or something on FB, and only if I felt like being nice. and it's nice to see them for that purpose, but That's about it.

I did get a similar feeling; if his work was already has been sent to the copyright office (assuming) I wouldn't give the same offender a second chance but let the lawyers do the work. That's a lot of work for him just chasing tail when it's clear he's a professional photographer if he is making a living like you said.
