Commercial Licensing youth team photo

Happy New Year everyone.

I did a shoot last week for a youth ski team. Normal team portraits and group photos. Nothing special there, just charged a flat fee per skier for a given photo package.

A few hours ago the President of the team emailed me to ask if I could talk to a person who wants digital files of the group shots.

The person represents the gear (jacket and pants) company the team wears. I know for normal commercial use a model release is needed from those who are in the photos. But this seems like a different deal to me.

Any ideas on the legalities of this? I've searched all over and have not come across a situation like this.

Any ideas would be greatly appreciated. Thank you.

You can license the photo to him. In order to use it he needs the releases. He might already have releases in place for their likenesses to be used as part of his sponsorship agreement.

I've emailed and am waiting a reply from the president. I asked if the company is an official sponsor of the team and if the papers signed by the parents grant commercial use of their likeness. If so, it should be good to go.

It depends on how the company intend to use the images. If they just want to make prints to hang on the office wall they wont need a release. If they want to use the images in advertising they will need a release.

I'm still waiting on return emails from the president and rep. My guess is it will be posted on their website. That's advertising as far as I'm concerned. Just not sure how they will use it yet.

How they will use it really doesn't affect your ability to sell it to them. It is their requirement to have releases if they use the photo commercially, not your requirement to have a release to sell it to them.

Unless they tell you they won't buy it without releases...
