Since people on here have questioned that you can really get paid from these things, here is a blog about how an agency had to pay $8k for a pretty crappy picture of Nebraska.

Enjoy. :D

Both lawyers made more than either party involved. Bet on it.

Its funny how she puts all the blame on lawyers, and the need for changing these silly copyright laws, and no real understanding that they committed theft.

"I could spend 3,000 more words trying to reinvent the wheel by describing how to avoid infringing on copyrights"

Well you could write 3,000 words, or you could just say...don't use things you didn't create, pay for, or ask for first. That's just good, common sense manners.

What I find striking is how hard they're now working to belittle the quality of the image that they had to pay up for.

complete with an altogether underwhelming photo of the city, which may or may not have been taken by a drunken college student with a camera phone in 2005.

We should’ve noticed that the photo used in the blog wasn’t up to par. It just wasn’t a good shot, and there are about 5,000 others would’ve been better suited for the post.

Those comments are more suited to junior highschool girls than a company whose "editorial standards are obnoxiously high, and we do our best to write the best Web content our clients (and their competitors) have ever seen."

Everyone gets a little bitter when they have to pay more than they expect to cover a mistake. That bitterness flows here.

They are lucky they settled for $3k. My attorney gets 1/3rd and wouldn't have settled for $1k. It also sounds like they wasted a good bit of time trying to get out of it. The attorney has to respond to all those things.

It isn't uncommon, in my experience, for there to be 30-40 emails written between the offender and my attorney to settle everything.

I don't understand how a small company with a few employees that writes internet articles and blog content full-time doesn't understand the basics of online copyright infringement. Or are they just playing dumb?

What's better then having to pay 8K for copyright infringement? Settling for 3 and netting 2! I personally never questioned payouts, just multiple big ones or even "a" big one for Joe photographer. I wonder what kind of car they buy with the 2K?

The stuff that really made me laugh was that they talk about how they provide blog posts for clients yet they selected this "crappy picture of Nebraska" use in the post. Surely they could tell it was crappy when they selected it. They also tried to argue that as no one read the post in question they shouldn't have to pay so much - doesn't say a lot for the quality of their work.

"A cheap mistake" would have been a better thread title...

The blog writers were being cheap when they wrote the article... they got off with a relatively cheap settlement too.
