Merlin? ID Please

We have a lot of birds in the back yard as we seed, attracting predators as well. It appears to be a Merlin, but not 100% sure.

Thanks! I was pleased with it considering I had to shoot through a double pane window.

Fantastic shot period. Even more so through double pane windows. Definitely looks like a Merlin.
