I was looking at a discussion about this on another forum, and there was some debate as to whether it was ever illegal in the first place. Seems like that particular law is poorly written, with the wording "nude or partially nude."

Everyone is nude or partially nude underneath their clothes.

I think the loophole is underwear, but what happens to the "artist" that happens across a model that has decided to go commando?

Seems that image would cross over the "partially nude" line...

The question posed in your first sentence is answered by your second sentence.

I wonder if law wants to go so amiable here, what would be the the other laws applying to person of keen breaking camera of lawful photography or whether if the jury or judge are any merciful to the attacher of the photographer that seems to be involving in his very lawful photo practice, with his north pointing photo habits, by the unwanted photographed person!?

Also really do you see yourself coming to a photographic forum like here (And I am not talking of many other web sites already dedicated to this with extensive galleries) and see a sub-forum under title of "Upskirting"!!!

I wonder what's in the exact wording of the new law, and how it can be misused in such a way that all photography is criminalized.

Take a picture of the crowd at a baseball game, and there's a lady 14 rows back whose blouse has lost a button? See you in court.
Guess what? That lady was only 17 years old. See you in five to seven years.

It may have been legal then, but I'll bet he spent more on his lawyer than a trip to Cancun would have cost? ; D
