My oppologies for the wide photo, but I wanted you folks to see everything. Hopefully what I have done here clearly illustrates my problem. I cut out a chunck of the out of focus stuff and moved it to the in focus side for easy comparison.

These were shot with a 10D using a Canon 28-105 USM zoom. When the lens is set at 28ish end of things the focus falls apart on the left side of the photo. I know this isn't the best lens canon has to offer - am I being too critical or should it maintain focus in a situation. The problem follows the lens and not the body. I tested out my 75-300 the same way and its nice and crisp all the way across the photo.

What do I do???

Thanks in advance!

Well the lens shouldn't do that, even wide open.

I haven't had trouble with EF lenses but certainly things point
to Canon dropping their standards and quality control.
The new 28-90 has had awful reports.... getting like one star out of five.

If the lens is under warranty I'd take it back and ask for a replacement.
