So It starts.
In a nut shell, a drone was hovering over his property near where his daughter was sunbathing. He shot it out of the sky, and was arrested.

Yea.. The guy is pretty much an idiot. That is definitely not the way to handle the situation.

Anyway, this is not really the start, I seem to recall a similar incident about 6 months ago?

I'm not too sure about use of deadly force laws in Kentucky, but in Indiana you have to have all three of these bases covered before lethal force is justified:

1.) The offender must have a weapon capable of inflicting grievous bodily injury or death. Yes, that may include bare hands.
2.) The offender must be threatening to use that weapon. No, it does not need to be verbal.
3.) The offender must be in proximity to deploy that weapon. The courts are very liberal in interpreting this one.

In Indiana, the nutjob with the shotgun would also be arrested. Good.

Here's my thoughts FWIW...

Yes, the guy should not have discharged his weapon within the city limits. Lots of laws about that no matter where you live as some may get hurt from direct/indirect fire or from gravity rounds impacting.

My opinion (and I live in the country where city laws do not apply) is that if you fly a drone over my property, scoping out the area, you can bet your ass I'm going to blow it out of the sky.

1. Private property and you're trespassing. Clear and simple.

2. I have no idea what your intention is. Are you scoping the place out to see if anybody is home prior to robbing me (hint: your drone falling helplessly to earth told you someone is home)

3. I don't give a damn if that thing costs you tens of thousands of dollars. You want to fly it, take it to a public park as you would a model airplane or Estes rocket.

BOTTOM LINE: Be respectful of others and their Right to privacy and you'll have a long positive relationship with your drone.

I think most folks would agree with Doug. The real issue is that it is about time to address privacy rights in this country, again. Most people here are aware that individuals have next to no right to privacy in public places. We'd also agree that you'd be a damn fool to hang around outside the fence at a public pool taking photos of children. The drone thing just takes that kind of matter to extremes. And to backyards all over the country. We should have some degree of privacy in our own yards.

Using a firearm was perhaps not the smartest thing he could have done, though a shotgun with bird shot is not much of a threat after 50m.

I agree with everything you said. I don't even own a gun, but this seems right somehow, if only to start a conversation about privacy vs. drones.
