Was this finger trouble with my 5DS R found it in live view??

I never use live view, I had left the camera power switch on by accident somehow, I noticed it when I went to pick it up. And the fully charged battery was now at 39%. And the camera was in live view mode??

I assume I must have pushed the live view switch over - as I assume there is no way it could flick over to that?
Am I correct.

Also as the auto "switch off" timer setting was set to switch off in 4 mins, I am assuming if this was just me being clumsy/tired leaving it on in live view cant have hurt the sensor could it? Because it should have turned off in 4 minutes.?

Probably being over concerned as its so new. :-/

Obviously, there's no way the switch could have turned itself on, and you have no reason to expect the camera to have been damaged.

I am interested in your mention of the battery stats. Are you implying that it was fully charged, and that in live-view mode it still uses substantial charge even when in power-save mode?

I think the camera will stay on in live view mode. I once prepped my 1D4 for a shoot and shoved the camera in a bag. Unknown to me, the SET button was pressed in the bag which turned on live view mode. When I got where I was going and pulled the camera out to shoot, the battery was completely flat and I was SOL.

That was probably 4 years ago and the camera is fine, so this isn't like something you really need to worry about, other than the annoyance of having a flat battery.

If the camera isn't turned off when you put it in a bag, then a trigger button or something may be pressed inside the bag, bringing it to life now and then. If it then is in live view mode, that will consume more power, since the rear display is on for a long time.

Turn your camera off when putting it in the bag. It also allows sensor cleaning to run automatically.

Having the camera in bulb mode doing long star trails and having the camera in live view are basically the same thing, other than you are also running the rear LCD. There should be no issue.

Yes unless I was mistsken, and had charged the wrong battery. Possible with 2 cameras and 4 batteries ( as they use the same type).
