Copyright = different than ownership. If you make a profit from an image of a copyrighted object...you owe the copyright owner a royalty. If you adorn your own house with the image...no harm no foul.

This is the Official Photography Policy from the NPS Park Police for the DC Park Grounds and Monuments:

Most of these are aimed at commercial photography (Which requires a permit)

TRIPOD USAGE WITHIN RESTRICTED AREAS IS STRICTLY PROHIBITED WITH OR WITHOUT A PERMIT.

B-roll footage MAY be permitted if the project is directly related to the purpose of the Memorial.

Lincoln Memorial: Filming/photography is prohibited above the white marble steps and the interior chamber of the Lincoln Memorial.

Jefferson Memorial: Filming/photography is prohibited within the columns and the interior chamber of the Jefferson Memorial.

Washington Monument: Filming/photography is prohibited within the circle of flags surrounding the base of the Washington Monument.

Vietnam Veterans Memorial: Equipment set-up of any kind is prohibited at the Vietnam Veterans Memorial including, but not limited to, microphones, speakers, lights and musical instruments.

Three Servicemen Statue: The Three Servicemen Statue, located adjacent to the Vietnam Veterans Memorial, is a copyrighted piece and, therefore, may NOT be filmed or photographed for commercial purposes without express permission from the artist.

Vietnam Women's Memorial: The Vietnam Women's Memorial may NOT be filmed or photographed for commercial purposes.

Korean War Memorial: Due to copyright restrictions, filming within the Korean War Memorial must be done with a handheld camera. Equipment set-up of any kind is prohibited. Any footage must credit the artist, _______________.

FDR Memorial: Due to copyright restrictions, commercial filming/photography is prohibited within the FDR Memorial.

I have seen, and have personally, broken just about every one of those restrictions. I however am not a commercial photographer nor do I resell the images of the DC monuments that I have taken. I usually take my shots late at night and have never encountered a park ranger.

What does B-roll mean?

So if for personal use, are there any restrictions? I need to get down there sometime and take a stab at some of these memorials I haven't been to in 40 years or ever seen. I've been to the museums qquite a bit more the past couple years.

I think if you go and shoot and are respectful of the area you would have no problems. If you care to take a look - here are some examples of shots I've taken while in DC.

I notice the guy had no problem suing the retired marine for the huge $1500 that the post office paid him.

This marine didn't even realize he did anything wrong. Suing the USPS is one thing, he didn't have to go after this marine.

I wasn't really responding to you per se. I was just commenting that if people are respectful of the environment in the memorial areas, and they don't seek to profit from the images they take, there will most likely be no problems.

If you do not defend your copyright then it becomes more difficult to collect damages at a later time; if you allow free use of the image by someone for, say, years, and then someone rips it off and profits, you may have trouble justifying copyright infringement to a judge.

Okay, I see your point, and that does make sense. The Marine did settle out of court, I wonder if they let him keep the money in exchange for admitting fault.

I've never had any problems. As someone mentioned, I try to be respectful of the crowd flow. I personally like to photograph at night and in the fall and winter if possible. Monuments look better at night, and the crowds are a lot less in the winter. I've shot as late as midnight in the winter. If you are traveling via Metro, keep in mind the closing time. Taxis are sometimes hard to get on the mall at night since the crowd is thin.

I'm certainly not in the same caliber as most of the shooters here, but I do enjoy it.

Great work! Makes me want to head down after dark to snap a few!
