To me it looks to be a female Bay-breasted Warbler. I think I see some orange coloration on it's flanks.

thanks! I took over 700 shots that day and I kept around 40.....lol, thank goodness for digital!!

Usually I pick out the shots I really like and delete the rest. I'd fill a lot of memory if I kept everything.
