Ok I have a question regarding NCAA photos. I'm particularly asking about Div I basketball but curious on everything from football, baseball, etc. I have tried to find info on this but I have not found much that helps. If I attend a game and take photos at the game, what if anything can I do with the images. Clearly I cannot sell them. But can they be used for other purposes such as website portfolio or can I post them on a business Facebook page (photography business page)? I'm not looking to sell anything, just share the photos. Anyone have any info on this? Thanks.
Why can't you sell them? Read the last line of the NCAA Bylaw 12.5.2.2 from the Div I Manual August 2016-17. The keyword is that the photo is sold for private use not commercial use.
12.5.2.2 Use of a Student-Athlete’s Name or Picture Without Knowledge or Permission. If a student-athlete’s
name or picture appears on commercial items (e.g., T-shirts, sweatshirts, serving trays, playing
cards, posters) or is used to promote a commercial product sold by an individual or agency without the studentathlete’s
knowledge or permission, the student-athlete (or the institution acting on behalf of the student-athlete)
is required to take steps to stop such an activity in order to retain his or her eligibility for intercollegiate athletics.
Such steps are not required in cases in which a student-athlete’s photograph is sold by an individual or agency
(e.g., private photographer, news agency) for private use . (Revised: 1/11/97, 5/12/05
