How to properly release images to client for use in a book

One of my regular photography clients has recently written a book and it is about to be published. She and her husband asked if they could use a couple of the photos I took of them for the back of the book for the "about the author" section. I have no idea what to do in this situation because I've never had anyone use the images I've taken of them commercially. I don't know what kind of form(s) to give them or what to charge. I appreciate any advice.:-)

Make sure you have registered your copyright for the work. You can get the license to them now, but get the copyright registered within the next 3 months to be covered for any infringements. It's not hard to do, you can register hundreds of images simultaneously, and you can do it online at copyright.gov (you can Google for hints and tips for filling out the registration).

In deciding what to charge, you may want to consider the value of goodwill, since this is a regular client.

First Rights is something that works to the publisher's advantage, not to the photographer's advantage. I don't understand how a first rights stipulation would have anything to do with the photographer getting future resell money - that just isn't making any sense to me.

Understand that you would need to grant


  1. ability to use your photograph in the book
  2. ability to use your photograph in the promotion of that same book


But you are not granting...

  1. any ability to transfer/confer to any third party the ability to use your photograph for non-commercial purposes,
  2. nor are you granting use of your photo to any parties, for any commercial purposes to promote any other products/services (other than #2)


Apart from that, you should probably cover 'future uses' within #1 and #2

  • re-publication rights, if any, for future editions of same book
  • publication rights, if any, for publication outside USA (i.e. foreign publication)
