Considering the position of the legs of the bird on the left implies take off or landing, the first one makes sense but the second looks peculiar.

I would go for the first one.
The second one seems like something is missing with the bird trying to land on the tree.

First one, but with a tighter crop. Just show a hint of the tree at the bottom of the crop.
