Seller claimed this "Excellent, like new condition with no scuffs or scratches." Looks like it was dropped or hit a cement wall to me. He had the ball to say that I tried to cheat him :-(

I hope the dust is from packaging. If/when I sell something as pristine, you don't see dust in the photos. Anyway, I agree with the 'dropped' damage. Ebay/PP will surely refund your money, regardless of the seller's opinion.

The KEH definition of excellent reads

"EXCELLENT CONDITION." 80 to 89 percent of original. Shows moderate wear for the age of the item, with the possibility of small dings or blemishes. Glass may have slight blemishes but will not affect picture quality.

eBay specifically defines "Mint" as

An object described as in "MINT CONDITION" means, literally, that the item looks as if it just came off the assembly line in the factory; that there is not a single defect of any kind in the product. It is in the BEST possible condition a product can possibly be in.

It is obvious that Mint does not apply.

I feel your pain. Just bought a 17-40 from a seller on FM that was supposed to be working great. Got the lens and found the AF to barely work. Sometimes it just clicks to try to find focus, sometimes it does nothing. Sometimes it works. Same result on 3 different camera bodies. Selller claimed it was fine when it left and said that he wouldn't refund. Once it's shipped he claimed it's on the buyer.. Lol. Offered to pay $50 as good will towards the cost of fixing it "if indeed it had a problem". Umm no. Obviously unaware of how paypal works. Had to file a claim.

I'm surprised at the condition of the lens box (not the shipping packaging). When I unpack a new lens, the box is stored away, not any place special, but the boxes remain in pristine condition. That box looks like it was his method of transport while using the lens.

Buckeye seems to me that your a very experienced buyer/seller you purchased lens without benefit of seeing photos? As far as
box condition doesn't mean a thing its whats inside that counts.

He only sent the images that made the lens looked great. He had the hood on, so you couldn't tell the hidden damage. The lens box was not my concern, how he packed it worried me more...especially when he said what he said without knowing how I pack my gears :-)

He said his wife was the one that packed and sent the lens.
