Not quite sure why this needed to be discussed in the highest European court - but it seems that there was some uncertainty around this topic in the EU.
Nice to see that common sense is prevailing. Just because everybody can access it, it is not free for all to do with it what ever they want....

Nice to see that common sense is prevailing. Just because everybody can access it, it is not free for all to do with it what ever they want....

I believe this is to keep people from making memes. They've been a very powerful tool getting messages out, plus they don't show up in search engines like words do.

I think this will be a kick in the teeth for Pinterest in the EU. I have always thought that they overstepped the mark because instead of always just hyper-linking to pages and images they re-publish on their own servers. This ensures that the image doesn't disappear from the users pinned images feed. Since Pinterest also allows sharing of those images that is in effect a publication.

At the moment it's pretty much impossible to find out if Pinterest is hosting any of my images without consent, without signing up for an account myself, something I really don't want to do. I just don't want to add even one to their user count.

This along with the new data protection rules look to give one a good way to force Pinterest to check and remove all of my "personal" data and copyright material from their servers.

Copyright - you can't just write and say "my name is Alan, remove all my copyright material". You need to know what material is on their system and ask for that to be removed specifically (with proof you are the copyright owner).

GDPR - Photos you took aren't necessarily "personal data" for the purpose of GDPR. If the Exif is removed there may be no mention of you so the image wouldn't show up if they searched their system.
